Trademark Infringement?

What do you guys think? This site http://www.filesaversdatarecovery.com has this phrase under their logo:
"The Data Recovery Medics"

Seems like trademark infringement to me. I normally wouldn't care, except that they created a Cranston, RI page. No one outside of RI has ever heard of Cranston, so I know they got it from scoping out my site.

It's like the whole logo is a convolution of Drive Savers and Data Medics.

Yeap, if you have your name registered, I don't see why not. But I'm not a lawyer.... :mrgreen:

I'm not a lawyer either, but windows commander had to change his name (total commander) after bill gates (microsoft ;) ) sued him (so I heard)

Man, I'd need a team of lawyers. Good thing I just trademarked it to protect myself from anyone's cease and desist orders under a trademark. Now if anyone has a complaint about me using it, I can slap them back with a court order.

Yeah, that's about all it's good for, I figure. You'd go broke pursuing everybody who using a similar name.

Exactly. Short of actually using the name Data Medics and copying my content like that one website, I don't expect to do much enforcing. Just protecting my own rights to use the name without any issue.

Yep, he who trademarks first owns the rights. Like I said, did it only to protect myself.
